Derby landlord handed fine for breaching Improvement Notices

Derby City Council has successfully prosecuted Mr Jaswinder Singh Khatkar who was handed fines totalling £18,956.

Jaswinder Singh Khatkar, Chartered Management Accountant and portfolio holder of residential properties was prosecuted by Derby City Council Housing Standards Team in South Derbyshire Magistrates Court on Thursday 6th February 2020. The prosecution related to offences at his rented properties on Hartington Street, Derby.

In August 2018, an inspection of two of his large properties on Hartington Street was carried out, where category one and two hazards were found to exist. Due to the nature of the hazards found, it was determined the best course of action was to serve Improvement Notices, which formally requested the works be undertaken and clearly set out timescales by which the works must be completed.

Several compliance visits to the properties followed, where it was identified that very little work had been completed.

Jaswinder Singh Khatkar was found guilty of breaching 11 Improvement Notices and fined £11,000, ordered to pay the Council’s prosecution costs of £7,856 and a victim surcharge of £100.

In summing up, DJ Taffe said:

It’s a mystery to me how this case has been allowed to get to this stage… People, who are tenanted in these properties, are not exclusive but often some of the more difficult tenants to manage, but also some of the most vulnerable in society.
