Residents of Abbey Ward can now enjoy a bit of peace and quiet after Derby City Council successfully prosecuted a resident for breaching a Community Protection Notice.

The resident of Sudbury Close found themselves in front of Derby Magistrates after breaching the notice for playing loud music, and has now been ordered to pay over £500 in costs and surcharges.

The Council first received complaints in 2023 about a neighbour playing loud music, and a Community Protection Warning letter was issued. However further recordings were sent to the Council via the Noise App, which showed that loud music was still being played throughout the day.

The resident was issued with a Community Protection Notice, requiring them to reduce the volume to a level which would not disturb the local community.

Despite this, the noise continued and the Council received further recordings showing that the resident continually breached the legal notice.

The Sudbury Close resident attended Derby Magistrates Court on Monday 22 January 2024, pleaded guilty to breaching the CPN and was ordered to pay £500 towards costs and a victim surcharge of £26.

Councillor, Shiraz Khan Cabinet Member for Housing, Property and Regulatory Services said:

“There’s nothing more frustrating than constant, loud noise when you’re trying to work or relax. Citizens should be able to relax in their own homes but noise nuisances can be incredibly disruptive.

“This prosecution is a great example of partnership working between the Council, Metropolitan Housing and Derbyshire Constabulary. We won’t tolerate any form of antisocial behaviour, and this is the proof that we are prepared to take appropriate action to address issues such as noise, so that our residents can live happy, healthy lives.”
